T&C of boutique yachts

This are our terms and conditions. Please read this t&c carefully. Please understand that individual trip organiser policies apply as well and form an integral part of these t&cs.

Cancelation policy:

Should you need to cancel your booking, we ask you to notify us as immediately. All cancelations must be received in writing to [email protected]

Refund or cancelation charges as follows apply:

Any refunds outside of our terms will be subject to a claim on your trip insurance company. We will create a proof letter for your insurer over your loss, boutique-yachts and its subsidiaries can not be held accountable if your insurance reject your claims for any reason and boutique yacht and its subsidiaries are not responsible for any charges, fees or exchange rate losses in any cancelation or refund event.

Force majeure:

Boutique Yachts and its subsidiaries are not to be held accountable for failure to perform their obligations if such failure is as a result of acts of god (including fire, flood, earthquake, storm, hurricane, volcanic ash cloud, or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labour dispute or strike.

Illness during your trip:

For illness during a trip, no refund will be granted. On your request we will issue a letter for your trip insurance

Illness prior to trip:

The above cancelation policy applies. We strongly recommend a trip insurance to cover for such events.

Weather:

Boutique Yachts and its subsidiaries can not be held accountable in any way for any weather or situation caused by weather. Boutique yachts can not be held accountable for decisions from authorities regarding weather. Weather is not a valid reason for cancelation.

Boutique yachts and its subsidiaries reserve the right to rearrange, cancel or substitute elements of any itinerary without notice based on the conditions.

Responsibility:

The safety and well-being of our customers is our upmost concern. We expect our guests to follow the instructions of out partners at al times. Especially during activities like diving.

Boutique yachts and its subsidiaries are not to be held accountable for any losses, damage, death, injuries, or claims whatsoever arising from, connected or related to any activities engaged in by guests during a trip. This includes all shore excursions and transfers. Guests engage in all activities aboard or off the boat at their own risk.

Boutique yachts and its subsidiaries are not to be held accountable for any delays or interruptions caused by flight delays, cancellations or any other travel arrange made by or external or in conjunction to your booked trip.

Boutique yachts and its subsidiaries are not to be held accountable for failure of the customer to submit the requested personal data, passports etc.

Reservations and deposit:

Once a reservation is made by any means of communication, boutique yachts issues an invoice over the full amount and the invoice for the 30% down-payment the downpayment has to be payed within 7 days. With the payment of the invoice or the down-payment the reservation becomes valid and all terms and conditions are accepted on the side of the customer. Payment details as set out on your invoice.

Payment of the balance:

Payment of the balance must be made to boutique yachts latest 90 days prior to the date of departure. If full payment of the balance is not received by this date then boutique yachts can cancel the booking and enforce the cancellation policy.
Short notice bookings:
Full payment must be made to boutique yachts at the time of booking if the reservation is made less than 90 days prior to the date of departure.

Changes before conclusion of the contract:

Boutique Yachts and its subsidiaries reserve the right to make alterations and changes to brochure information, service descriptions and prices in the brochures or online and price lists at any time.

Price changes after booking:

In rare circumstances it is possible that prices must be increased. The circumstances under which this may occur are as follows: – high increases in transportation costs (including fuel costs)- high increases in state taxes and duties (i. E. Airport taxes, landing fees, embarkation/disembarkation fees, sales taxes, etc. )- high currency fluctuations

Cancellation for reasons caused by the customer:

Boutique Yacht reserves the right to cancel a trip if the customer give a justifiable reason to do so eg. Customer lies about their personal data, damages the boat, does not obey by the rules on board, endangered the boat or the guests, marinelive or third parties etc). In such rare instance boutique yachts will not grant any refund.
